When you purchase a property, there are four basic choices that you have when you acquire ownership to the property.  The type of ownership is determined by how many people and by the  relationship to one other.  Below is an outline of the ownership options. 

 

SOLE TENANT:

 

A Sole Tenant is when just one individual owns the property.

 

TENANTS IN COMMON:  

 

Tenants in Common describes ownership by two or more individuals whereby each owner has an undivided interest.  Each owner is entitled to equal use and possession of the property.  There is no right of survivorship between Tenants in Common; therefore, an estate must be opened in order for the property to be passed through the estate of the deceased tenant’s heirs.                                                                                                                                              

 

JOINT TENANTS:  

 

Joint Tenants describes ownership of two or more individuals with a right to survivorship.  Each individual owns an undivided interest in the property and each is entitled to equal use and possession of the property.  Since there is a right of survivorship, upon the death of one joint tenant(s), the property belongs to the surviving joint tenant(s) and will trump the will.  

 

TENANTS BY THE ENTIRETY: 

 

Tenants by the Entirety is reserved for a husband and wife.  This tenancy has the same features of Joint Tenants, whereby upon the death of one tenant, the property transfers to the surviving spouse.  Also, because the marital unit is considered to be “one person” in the law’s eyes, the single marital unit is the owner.  As a result, and for the exception of some tax liens, claims against one spouse are not liens against the property.
