There are two types of land ownership.  Below is a brief explanation of those types and related information.  

 

Fee Simple

 

Fee simple is the highest form of land ownership that a person can have.  Fee simple interest  means that you own the land upon which your home is situated.  You are free to do whatever you’d like with the land if you possess fee simple interest.  

 

Ground Rent

 

Often referred to as leasehold interest, ground rent means you don’t own the ground on which your home sits.  The home owner must pay a semi-annual nominal fee to the ground rent owner of record.   Ground rents in Maryland date way back to the colonial times in American history and have evolved a bit over time.  It’s important that the homeowner pay the ground rent, as failure to do so, can result in the ground rent holder placing a lien against the property for the past due amount.  If foreclosed upon, the homeowner would only get to keep the amount of equity that has built over their time living in the home.

 

Purchasing Your Ground Rent

 

If a homeowner chooses to buy the ground rent from the ground rent owner, by law, the ground rent owner must sell it to the homeowner.  The ground rent lease must have been created after April 8, 1884 in order to be redeemed.  The price to redeem the ground rent is determined by the date that the lease was created and by the amount of the annual ground rent.  The law only applies to residential property.  A real estate attorney or a title company can complete this process for you.
